The Promoter

The Promoter under licence granted at Galway District Court on the 2 February, 2021 is CROI – THE WEST OF IRELAND CARDIAC AND STROKE FOUNDATION COMPANY LIMITED BY GUARANTEE incorporated under the laws of Ireland with Registered Charity Number (RCN): 7500, having its registered address at Croi House, Moyola lane, Newcastle, Galway.

The Prize

The prize on offer is a brand new Volvo XC40 T2 (Petrol) from Kenny Galway.  Please note that the prize can be claimed from Kenny Galway ONLY and cannot be claimed from any other garage.  The prize is not redeemable for cash.  Vehicle Registration is included.

The Promoter does not accept any responsibility or liability to the winner for any dissatisfaction with the Prize. The Prize is provided “as is” and the Promoter does not make any representation nor give any warranty in respect of the Prize.

The Raffle Draw

Entry to the Raffle Draw is by means of a raffle ticket specially commissioned by the Promoter. On purchase of a ticket for the Raffle Draw, all purchasers of tickets are automatically entered. Tickets must be retained as proof of purchase and Purchasers will be asked to provide their first and last name, e-mail address, postal address and telephone number which will be written on the ticket at the time of purchasing a ticket. Failure to provide any of the foregoing or accurate contact details at the point of purchase may result in an inability on the part of the Promoter to contact the winner. The Promoter accepts no responsibility or liability to the winner for any failure on the part of the winner to provide full and accurate contact information.

Raffle Draw tickets are priced at €20.00. By purchasing a ticket, entrants agree to be bound by these terms and conditions. Please retain a copy of these terms and conditions for your reference.

The Raffle Draw is only open to anyone aged 18 years or over.

Winner selection

One winning ticket will be drawn by an independent judge appointed by the Promoter for that purpose. The Independent Judge will also be invited to draw 5 additional tickets which shall be numbered 1-5 at the time of same being drawn .

How to claim

The Promoter will use all reasonable endeavours to contact the winner within 10 working days of the winner being selected and shall only use the contact details supplied at the time of purchasing the ticket for this purpose. The name of the Winner shall be posted on the website of the Promoter, namely www.croi.ie once the draw has taken place and the Winner hereby expressly consents and authorises the Promoter to use this data for this purpose.

The Promoter will not enter into correspondence with third parties and is not obliged to use any contact details other than those provided at the time of the ticket being sold.

If a winner does not claim the Prize within 5 weeks of their selection as Winner being communicated to them then in that instance the Prize will be awarded to the purchaser of the additional ticket numbered No. 1. and the Promoter shall communicate notice of this to the purchaser using the details provided at the time of the ticket being purchased. In the event that the Prize is not claimed within 5 weeks then this process shall be repeated with additional tickets numbers 2, 3, 4 & 5 in that order.

Publicity

All entrants hereby agree and consent to the Promoter using their contact details and an image if their likeness for the purpose of announcing the winner of the Raffle Draw and for related promotional purposes which the Promoter, in its absolute discretion shall decide.

Restrictions

Individuals who attempt to circumvent, alter or interfere with the Raffle Draw in any way, will be precluded from being chosen as the Winner of the Raffle.

If there are reasonable grounds to believe that there has been a breach of these Terms and Conditions by an entrant, the Promoter may, in its sole discretion, communicate notice of such a breach to the offending party using the contact details provided at the time of purchasing the ticket. The Promoter reserves the right to disqualify the offending party in their entirety.

Promoter’s right to modify or cancel

The Promoter, in its sole discretion, reserves the right to modify, temporarily suspend or cancel this competition at any time but only in the case of cancellation shall stakes be returned to the purchasers.

Limitation of liability

The Promoter’s liability in contract, tort (including, without limitation, negligence) or otherwise arising out of or in connection with or in relation to these terms and conditions, or arising out of or in connection with or in relation to any non-contractual arrangement shall be limited to the amount actually paid or payable by the entrant for the raffle ticket.

The limitation of the Promoter’s liability herein has effect in relation both to any liability expressly provided for under these terms and conditions and to any liability arising by reason of the invalidity or unenforceability of any term of these terms and conditions.

Governing Law and Jurisdiction

The terms and conditions herein are governed by Irish Law and the parties submit to the exclusive jurisdiction of the Irish Courts.
